INDIVIDUALS WITH DISABILITIES EDUCATION ACT (IDEA) This directory is funded through the Department of Health and Social Services’ Birth to Three Early Intervention System under the Individuals with Disabilities Education Act (IDEA). Part C of that federal law, which is administered by the Department of Health and Social Services, provides funding and management to support a statewide, comprehensive, coordinated system of early intervention services for infants and toddlers with disabilities and/or developmental delays and their families. Delaware's early intervention services are coordinated through the Child Development Watch program in the Division of Public Health. Child Development Watch is composed of staff from a variety of state agencies that work together to provide multidisciplinary assessments, service coordination, plan development and service delivery to eligible children from birth up to age three and their families. Referrals can be made to Child Development Watch at 1-302-995-8617 for New Castle County and 1-302-424-7300 for Kent and Sussex Counties. As part of IDEA, the Interagency Coordinating Council (ICC) has been appointed by the Governor to assist and advise the Department of Health and Social Services in the development, implementation, and ongoing improvement of the early intervention system. The ICC is composed of parents, state agency personnel, private providers, insurance providers, legislators, and professionals involved in personnel preparation. The following page lists current ICC members. In addition to this directory, the Birth to Three Office also produces Growing Together, a portfolio of information for new Delaware parents. This is distributed through Delaware hospitals to the family of each newborn. The portfolio contains a Health Journal to record information on the child's health and development; a newsletter, Great Beginnings, from the University of Delaware Cooperative Extension; a developmental calendar which follows the child's growth from birth through age five; a list of helpful phone numbers for Delaware parents; and a READ-ALOUD nursery rhyme book to encourage early reading to children. SUMMARY: The Division of Developmental Disabilities Services offers services as part of Child Development Watch to any child, birth to three and their family, who is at extremely high risk for mental retardation as outlined in the Memorandum of Understanding approved between Division of Developmental Disabilities (DDDS), Division of Management Services (DMS) and Division of Public Health (DPH). These services, provided by Developmental Nurse Specialists, include service coordination, neuro-developmental assessment, intervention for developmental and/or medical problems and facilitation of the role of parents as primary advocate and teacher for their child. The Developmental Nurse Specialists also serve as consultants to other service coordinators, physicians, and public or private agencies. DDDS offers different types of respite experiences depending on the needs of the individuals and family requesting the service. Respite is a term used to identify a situation in which individuals with mental retardation are given a period of temporary relief or rest. They can experience a social/recreational experience in the community while their family is afforded a period of relief from the daily care responsibilities. The length of the respite is pre-determined according to the family’s need and the availability of resources. Respite mainly takes place in the private home of a DDDS screened and qualified provider. However, a provider may come to the family’s home to care for the individual or the family may choose their own provider. Any infant, child or adult who is formally assessed to have mental retardation and who is a resident of Delaware is eligible for the program. Requests for services may be made through the Intake Coordinator or the regional respite coordinator of DDDS. Under the Omnibus Budget Reconciliation Act of 1987 (OBRA), the Division of Developmental Disabilities Services will work with a family who is referring a child for long term care outside the home. DDDS is responsible for determining if the child is eligible for placement, could benefit from specialized services and is nursing home appropriate. DELAWARE DEPARTMENT OF EDUCATION EARLY CHILDHOOD ASSISTANCE PROGRAM (ECAP) The Early Childhood Assistance Program (ECAP) provides, through State funds, a comprehensive early childhood program using the Head Start Standards for service, as a model for four year old children living in poverty. Federally-funded Head Start programs provide preschool education and support services for 3 and 4 year old children of low income families and other children with special needs who meet eligibility criteria. Federally-funded Early Head Start programs provide services to pregnant women and children, birth to three. Delaware Housing Partnership – Provides loans up to $10,000 at 6% interest for down payment and closing cost assistance to low-and moderate-income homebuyers in Delaware. Participating lenders provide loans for the purchase of affordable, newly constructed, homes throughout Delaware. Public Housing Homeownership Program – Provide homeownership opportunities to qualified low-income families. Families rent DSHA-owned, single family homes for a maximum period of three years. While renting, families receive one-on-one homeownership, credit and budget counseling from a nonprofit agency and save money for the home purchase in a special escrow account. Live Near Your Work Program (LNYW) – An employer driven partnership among Delaware businesses, state agencies, local jurisdictions and Fannie Mae to provide financial assistance for employees to purchase homes near the place of work. RENTAL HOUSING ASSISTANCE Public Housing Program – Provides safe, decent, affordable rental housing and access to supportive services to very low-income Delawareans in Kent and Sussex Counties. Public Housing is designed to be a stepping stone for responsible families seeking self-sufficiency. Resident families pay approximately 35% of their adjusted monthly income to rent a unit at one of DSHA’s nine Public Housing sites. Low Income Housing Tax Credit Program - Rental housing sites built throughout the state under this program are privately-owned and have rents that are affordable to working, low-income families. HOUSING REHABILITATION ASSISTANCE Housing Rehabilitation Loan Program - This program offers a 3% percent interest rate loan to low-income Delawareans for the purpose of rehabilitating their properties to bring them up to housing code standards or to make properties accessible to persons with disabilities. Landlords renting to low- to moderate-income tenants may also qualify. Community Development Block Grant Program – Provides annual allocations to communities in Kent and Sussex Counties to help finance a variety of activities designed to improve housing conditions and public infrastructure in support of housing development for low- and moderate-income families. There are often resources to assist you but they can be difficult to locate. Although your primary agency worker may be familiar with some of the available resources, he or she may not be aware of all options. In most cases, you will be your child's best advocate in finding funding resources. It is often possible to receive financial support from several state agencies at the same time, or from both private and state agencies. In addition, because you receive one source of funding, you should not feel limited in trying to obtain money for additional services. Eligibility varies from agency to agency and may change from year to year, so do not give up. Talk to other families of children with disabilities about funding sources and share information. Adoption/Foster Care and Adoption Because it is expensive to care for a child with special medical needs, additional funds may be available for a family choosing to adopt or care for child with disabilities. Supports in adoption for special needs children may be available in the Adoption Assistance/Subsidy Program administered by Division of Family Services, Dept. of Services for Children, Youth and their Families. Equipment/Assistive Technology Each medical insurance carrier has its own policy regarding equipment coverage. Always explore your needs with your health insurance provider. If coverage is not available, or if you need a short-term loan while waiting for delivery of your own equipment, you may need to contact another resource. If a child is a patient of DuPont Hospital for Children, the hospital will help obtain pediatric equipment. For a child who is eligible for Medicaid, medical equipment, such as wheelchairs, hearing aids, should be covered. A prescription is required and medical equipment must be approved through a home health agency, hospital or rehabilitation clinic. These agencies must also be Medicaid approved. Check with the home health agency directly. Also, your child's school may be able to purchase equipment if an educational justification can be made. Contact your child's principal. The Department of Education funds Learning Resource System Centers for Technology, which allows you to preview communication devices and early childhood learning computer programs which could enhance your child's ability to communicate and to learn. A local chapter of any civic organization such as Elks, Kiwanis, Lions, Knights of Columbus, Rotary and Shriners Clubs (as well as others listed above under Architectural Accessibility/Housing) sometimes provide funds for specific equipment needs for a child in their local area. Home Health Care Funding for medically necessary services provided by nurses, aides, and specialty therapists, may be covered by a family's insurance carrier, Medicaid, or by the Division of Public Health. When the need arises for additional home health care, alternative funding and information may be obtained from local hospitals, Division of Public Health or home health agencies. Home health care may be referred to as "respite" as it refers to assistance a family needs in caring for a child with special needs. The variation in names is based on the definitions used by the funding source, the level of care required by the child, and whether the parent is to be assisted or totally relieved of responsibility for a short period of time. Medical Needs Ideally, your child's medical needs and services are met through your private insurance agency. For your child with special needs to be covered as completely as possible, you must be aware of specific issues guiding coverage. For example, you should pay special attention to pre-existing medical condition clauses which may state that if your child's medical condition developed prior to obtaining present insurance, you may be denied certain coverage. Your insurance may also have specific coverage limits. Check for lifetime or annual limits per child as well as limits per illness or individual procedure. You may also want to inquire about eligibility for "prolonged illness coverage" or an individual "rider" to gain additional or extended benefits. Medicaid Managed Care Medicaid/Medicaid Managed Care is a federal/state public assistance program that will pay covered medical bills for ABC and Supplemental Security Income (SSI) recipients, adults with gross income at or below poverty, as well as certain other groups of low-income people who meet eligibility criteria. There is also a program known as the Medicaid Alternatives to Children’s Institutionalization (MACI) which does not include the parents' income or assets in determining eligibility. Specific other criteria related to the child's disability must be met along with other conditions. The State Medicaid program, which is administered by the Division of Social Services, has several different eligibility categories. The most commonly used Medicaid categories or those of particular importance for parents of children with special needs are: (1) for those children receiving cash assistance under “A Better Chance” (ABC), and the General Assistance Program; (2) for children receiving Social Security Supplemental Security Income (SSI) Disability Program; (3) for children with disabilities under the Medicaid Alternatives to Children’s Institutionalization (MACI) which takes into account the child's income, only where a child's income and resources do not exceed 210% of the SSI standard, and whose condition is such that medical institutionalization would be required if the caretaker relative were unable or unwilling to continue care; (4) for children in subsidized adoption; (5) foster children in custody of the Department of Services for Children, Youth and Their Families; (6) for infants under 1 and children ages 1 to 8 whose family income is below a certain % of the federal poverty guidelines; (7) adults whose gross income is at or below the federal poverty level. The Delaware Division of Public Health administers a special fund to provide needed evaluation and treatment services for medically needy children whose families have inadequate third party coverage and who are ineligible for Medicaid. Contact the Division of Public Health, in Dover. Travel and Transportation - DART First State Paratransit Service The paratransit service provides transportation for ADA certified customers. Reservations are required at least one day in advance. The service operates statewide on weekdays with limited Saturday service in New Castle County. This service is available for children with disabilities. A parent or aide must accompany a child under 5 years old, and must bring a securable car seat.
